A failure to follow procedures led to the escape by a capital murder suspect who fled a Dallas hospital with a deputy's duty weapon, the county sheriff says.

Franklin B. Davis, 30, escaped from Parkland Hospital on Tuesday night, the Dallas County Sheriff's Office said. He was taken into custody later that night after a brief standoff.

On Wednesday, Sheriff Lupe Valdez said a failure to follow procedures, not an issue of manpower, let to Davis' escape.

"Standard procedure requires for all inmates to be escorted at all times while on medical visits to Parkland," she said. "Procedures were not totally followed; an error was made."

According to court records obtained by the Dallas Morning News, Davis asked his lone guard if he could take a shower. The guard then took off Davis' handcuffs and leg shackles.

Davis, who had been at Parkland since Saturday, then confronted the deputy with a sharp object and managed to wrestle away the deputy's gun after a two-minute struggle, the newspaper reported.

Valdez said it would not have mattered how many guards were watching Davis because policies were not followed.

The deputy was not injured but is struggling with what happened, she said.

Valdez said the heart of the problem is that prisoners must be taken to Parkland for treatment. There are about 4,200 transports between Lew Sterrett Justice Center and Parkland Hospital per year, she said.

She said a $40 million medical facility being built inside the jail should eliminate future incidents.

"It is incidents like this that confirm our need for a facility within the department," she said. "As you all know, we are working on that, and we are building a facility right here in the department so that we don't have to do the 20 to 25 visits back and forth per day."

Valdez said the incident is under investigation. The deputy is still at work.

Davis apprehended after brief standoff

Dallas police and Dallas County deputies searched the neighborhoods near the hospital for Davis and located him near Harry Hines Boulevard and Reagan Street.

Davis then barricaded himself inside a van in the parking lot of the old Telemundo building. Davis surrendered to police at about 10:45 p.m. after a standoff of a little longer than one hour.

No one was injured, and no shots were fired.

The standoff ended so quickly because police realized that Davis was not armed ,the sheriff's office said.

Authorities had recovered the gun, so officers went in to arrest him. Davis dropped the gun he took from the deputy at the hospital somewhere along Wycliff Avenue while fleeing.

Davis charged in slaying of 16-year-old high school student

He is charged in the September slaying of a 16-year-old Carrollton girl that he was accused of sexually assaulting.

Police said they believe Shania Gray was killed to prevent her from testifying against Davis, who was charged with four counts of sexual assault.

Carrollton police have said that Davis confessed to killing Gray.

According to an affidavit, Davis picked Gray up from school and drove her a trail head near Valley View Lane and Interstate 635, where he killed her. He told investigators that he posed as someone else and won the girl's trust with a fake social media profile and a prepaid phone.

A Fort Worth burglary victim has posted a neon green sign in his front lawn warning criminals he is armed and tired of break-ins.

Thieves broke into Amer Ozzie's home in the Riverside/Carter neighborhood on Friday and stole musical equipment, a TV, tablets and a video game console.

"Since I put the sign up, other neighbors have been coming up to me and saying, 'I've been robbed. I'm glad you're doing this,'" he said. "Other neighbors say they're going to put the signs up, too."

Ozzie, a Prince impersonator, said he is lucky that the thieves didn't steal any of his expansive Prince memorabilia or the two custom Prince guitars he uses for performances. But the bad guys took two amplifiers, forcing him to cancel a booking he had for this weekend, he said.

While NBC 5 was out shooting the story, two residents pulled over to say that they, too, had been burglarized. They didn't want to be identified, but one man said bank deposits for his small business were stolen from his car and a woman said tools were stolen out of her garage.

Ozzie, who grew up in the neighborhood, said he wants Fort Worth police to patrol the area during the day, when burglaries are happening.

Dallas police are asking for help in finding a couple who drove their pickup truck into the Texas Rangers store in Uptown.

Store surveillance footage shows the truck smash through the glass storefront on McKinney Avenue early Saturday morning.

"I'm pretty horrified that anyone would do that," customer Nela Moore said. "This really is Dallas' team right now."

Surveillance cameras caught the truck smashing through the front of the store at 2:30 a.m. The footage shows a man and a woman spend about 30 seconds ransacking the store, stealing T-shirts and other Rangers paraphernalia.

"That's too bad," customer Karen Moore said. "It makes the cost go up for everybody."

The store manager doesn't think the thieves had ever been in the store before because they went straight for the clearance rack with last season's playoff gear instead of high-priced jerseys.

According to the police report, the couple got away with a "large amount of merchandise."

Detectives said they believe the thieves drove a white Ford Dually pickup. Anyone with information is asked to call Crime Stoppers.

A New Jersey teen started a campaign hoping to change the way toy company, Hasbro, markets Easy-Bake Ovens.

McKenna Pope, 13, has a younger brother who enjoys cooking and wants an Easy-Bake Oven for Christmas.

Pope searched for the toy and found that none were marketed toward boys. She only found marketing materials that featured girls using pink or purple-colored Easy-Bake Ovens.

Pope wants her little brother to know that cooking isn't only for girls.

The eighth grader started a campaign on Change.org, hoping Hasbro will acknowledge the bias and create gender-neutral Easy-Bake Ovens.

The petition is addressed to the CEO of Hasbro and senior executives.

The Dallas-Fort Worth International Airport Board will vote Thursday on a new $100 million development project that includes a hotel, postal center and retail complex.

The plan shows a potential 32-acre project, known as, Southgate Plaza, that would be built near the south entrance to DFW Airport, near the rental car facility.

The first phase would account for 17 acres, or more than half of that.

If approved, the project would result in a new 137-room Hyatt Place Hotel, a headquarters building to consolidate airport staff into one campus, a parking garage for 430 employees and a new United States Postal Service facility.

The estimated price tag for the first phase of the project is $92.1 million.

A Garland High School student will face a judge Thursday morning for bringing a loaded gun to school.

Carlos Rodriguez, 17, is facing a felony charge for having a prohibited weapon in a weapons-free zone.

Police said Rodriguez brought a loaded gun to school on Wednesday.

School leaders received a tip that Rodriguez might have brought a gun on campus. School authorities tracked him down and said they found a loaded pistol in his backpack.

The school resource officer arrested him and took Rodriguez to the Garland Detention Center. The teen spent the night there.

Staff at the detention center tell NBC 5 that Rodriguez is scheduled for an arraignment hearing between 10 a.m. and noon on Thursday.

The judge will set a bond for the teen.

Police haven't said why the teen may have brought the loaded gun to school or what he intended to do with it.

School leaders sent a letter to Garland High School parents and students on Thursday about the firearm possession.

Garland High School has increased security on campus since the gun was discovered.

The school district states that it frequently does weapons searched and will continue to monitor schools if any security changes need to be made.

AISD Expected to Name New Superintendent Thursday

The Arlington Independent School District Board of Trustees is expected to name Dr. Marcelo Cavazos superintendent of the district Thursday evening.

The board initially made the announcement on Nov. 2. that Cavazos was the lone finalist for the job. According to state law, school boards must wait at least 21 days after announcing a finalist before officially appointing a superintendent.

Cavazos has been serving as interim superintendent since the school board voted for an early end to superintendent Jerry McCullough's contract last June.  McCullough had been with the district for 40 years.

"I appreciate the opportunity to serve the Arlington ISD in this capacity," Cavazos told trustees after his interim appointment last June. "I respect the trust you have in me and my ability."

According to the district, Cavazos began his career in education teaching in the Mission Consolidated ISD in 1990.  Since then, he has taught in the McAllen, Mercedes and San Benito Consolidated ISDs before going to work for the Texas Education Agency in 1998.

In 1999 he joined the AISD as associate superintendent for instruction and served as interim deputy superintendent for seven months before being named deputy superintendent in Feb., 2009.  He has also taught at the University of Texas at Arlington.

Cavazos holds a bachelor's and a master's degree from the University of Texas - Pan American and a doctorate from the University of Texas at Austin.

According to state law, school boards must wait 21 days after announcing a finalist before officially appointing a superintendent.

The board said they will later announce when they expect a formal vote to extend a contract to Cavazos.  Cavazos will be the district's third superintendent in the last five years.

Car Found Sinking into White Rock Lake

Dallas Fire Rescue and Dallas police are responding to call of a car sinking into White Rock Lake.

Rescuers rowed out to the car in a small boat to see if it's occupied. Firefighters could be seen swinging a hammer at and breaking one of the car's windows as it slipped under the water, but officials said rescuers were not able to determine if anyone was inside the car.

DFR then went back to shore and began packing up their inflatable boat.

A dive team from the Dallas Police Department will now be called to the scene to investigate further.

The car is located about 50 feet off the shoreline near the 3800-block of W. Lawther Drive.
